FINAL GATE CONTEST APPLICATION AGREEMENT
1. PARTIES
This Agreement is entered into by and between GAIN MEDYA ANONİM ŞİRKETİ ("GAIN") and, on the other hand, the real person ('Applicant') who has applied to the FINAL GATE competition program ("Competition") published on the gain.tv website and whose name, surname, email, phone number, and address information are included in the Application Form.
The Applicant declares that they have read and understood all the articles of this Undertaking and accept them electronically.
2. AUTHORITIES AND OBLIGATIONS OF THE PARTIES
2.1. Applicant's Information Accuracy
The Applicant accepts and undertakes that all information (personal data, photos, videos, etc.) provided in the Competition Registration Form is accurate, complete, and up-to-date. The Applicant shall be solely responsible for any damages arising from incorrect or incomplete information.
2.2. Material Ownership and Usage Rights
The Applicant acknowledges that the photos and videos submitted during the application process become the property of GAİN and/or its group companies (Gain Shorts Medya Anonim Şirketi, etc.) and partners. These materials may be used indefinitely, without limitation, without geographical restrictions, and without obtaining additional permission from the Applicant in any program and/or promotional activity on TV, the internet, social media, and any other medium for the Competition and/or other programs.
The Applicant hereby accepts and declares in advance that they will not make any claims for rights, fees, royalties, or any other claims from GAIN and/or other relevant companies for such use.
2.3. Third Party Rights
The Applicant undertakes that the photos and videos used for the application do not violate the personality rights, intellectual property rights, copyrights, and other legal rights of third parties. The Applicant shall be solely liable for any legal or criminal liability arising from such infringements.
Should GAIN and/or its group companies be required to pay any compensation, expenses, or other payments due to such infringements, the Applicant shall be liable for such damages.
2.4. Communication Consent
The Applicant expressly consents to GAIN and/or its group companies informing them via communication tools such as telephone, SMS, or email about projects they will carry out on television, the internet, and other media outside of the Competition.
2.5. Contestant Selection
The Applicant acknowledges and declares that filling out the Competition Registration Form alone does not entitle them to participate in the competition and that the authority to determine the participants rests solely with GAIN officials.
2.6. Age Requirement
Applicants must be at least 18 years of age. Applications from persons under the age of 18 are invalid, and applications must be made by their parents or legal representatives and approved by the relevant persons.
2.7. Personal Data Protection
All personal data submitted by the Applicant will be stored in GAIN's database in accordance with the provisions of the KVKK and will not be shared with third parties. However, instructions from authorized official authorities or legal obligations constitute exceptions to this situation.
2.8. Right to Modify
GAİN reserves the right to unilaterally change the Competition format, conditions, the articles of this Undertaking, and all other elements related to the Competition without notifying the Applicant. The Applicant is responsible for regularly checking the gain.tv website for updated information.
3. EFFECTIVENESS OF THE COMMITMENT
This Commitment shall become effective electronically upon the Applicant's application via the gain.tv website and shall be binding on the Applicant in its entirety.

GAIN MEDIA A.Ş. HEALTH INFORMATION PROTECTION AND PROCESSING CONSENT TEXT FOR CONTESTANT CANDIDATE
With this Express Consent Statement, I declare that GAİN Medya A.Ş. ("Company") has provided me with the necessary information regarding the processing and transfer of my Special Category Personal Data in accordance with the provisions of the Personal Data Protection Law No. 6698 ("KVKK") and related secondary legislation, and that I understand all its provisions. I declare that I have been duly informed regarding the processing and transfer of my Special Category Personal Data within the scope of the Information Text and that I understand all its provisions.
I expressly consent to the processing of my special category personal data specified below for the purposes outlined in the Information Text and to the relevant international transfer thereof:

Transfer Abroad:
Due to the servers of the applications and systems used for the effective execution of candidate evaluations, communication activities, and organization/event management activities being located abroad, I acknowledge and declare that I explicitly consent to the transfer of my special category personal data listed above to servers located abroad and to service providers.
My Rights:
I acknowledge that I have the right to withdraw this explicit consent, which I have given in accordance with the KVKK and relevant legislation, at any time by contacting the Company. I also acknowledge and declare that I understand that I can apply to the Company to exercise my rights specified in Article 11 of the KVKK and that I can submit my requests to the Company.

GAIN MEDYA A.Ş. ("GAIN") aims to process the personal data of FINAL GATE contestant candidates in accordance with the Personal Data Protection Law No. 6698 ("KVKK") and other relevant legislation.
Due to your status as a contestant candidate, the personal data you have informed/will inform our Company and/or obtained by our Company through any external means will be processed by our Company as "Data Controller",
- Within the scope of the purpose requiring their processing and in a limited and measured manner related to this purpose,
- We inform you that personal data will be processed in accordance with the conditions foreseen in KVKK, maintaining the accuracy and most current form of the personal data you have informed or informed to our Company.
With this Information Text, it has been adopted that the activities carried out by Gain Media are maintained and developed in accordance with the principles in KVKK.
Collection and Procedure of Contestant Candidates' Personal Data
Our Company will process your personal data for the purposes specified in this Information Text. In case of any change in the purpose of processing your personal data, this Information Text will be updated and published separately by our Company.
The personal data belonging to contestant candidates collected and used by our Company are as follows:
Personal Data Categories and Examples:
Personal data covers all kinds of information that directly or indirectly identifies an individual and can be grouped in different categories. Identity data includes basic information such as name, surname, T.C. identity number and date of birth. Communication data such as phone number and email address shows the individual's connection with other people or institutions. Financial data covers information related to financial transactions such as bank account information and credit card numbers. Special category personal data contains more sensitive information such as health, ethnic origin, political opinion and is therefore subject to special protection. Visual and audio data (photographs, sound or camera recordings), biometric data (fingerprint, facial recognition information), educational and professional data (graduated schools), legal transaction data (criminal record) and marketing data (shopping history) are also important parts of this comprehensive personal data spectrum. Finally, health data such as disease information and blood type also constitute a sensitive subcategory of personal data that needs protection. These categories clearly demonstrate how diverse and comprehensive personal data is.
Your personal data is collected through the information and documents in the form you filled out on the internet site where you applied, in electronic environments and through visual and audio recording devices in physical environments during your visit to the relevant workplace as a result of your application.
Processing Purposes and Legal Grounds of Contestant Candidates' Personal Data
Your personal data will be processed in accordance with current legislation and the Personal Data Protection Law, for the realization of the purposes listed below, through automatic or non-automatic methods, in cases where your explicit consent exists and in accordance with the provisions in Articles 5 and 6 of KVKK.
The purposes of processing personal data are as follows and may be updated in line with our company policies and obligations arising from legislation.
Personal Data Processing Information in Contestant Candidate Application Processes:
Personal data collected in contestant candidate application processes is processed for specific purposes and legal grounds. This data is used for basic purposes such as conducting application and evaluation processes, providing communication activities. For these operations, the legal ground of Personal Data Processing Being Necessary for the Establishment or Performance of the Contract (KVKK Art. 5/2-c) is generally relied upon.
Among the collected data are identity (name, surname), communication (phone, email), professional experience, visual and audio recordings and other information. Processing this data is necessary for receiving contest applications and evaluating the suitability of candidates.
Additionally, in some cases, this data may be used for evaluating candidates in other programs and contacting them for this purpose. In such cases, the processing activity is based on the legal ground of Having Given Explicit Consent to the Processing of Your Personal Data (KVKK Art. 5/1).
Special category personal data such as health information is processed for the purpose of evaluating the health status of contestant candidates for contest suitability. For the processing of this sensitive data, the condition of Having Given Explicit Consent to the Processing of Your Personal Data (KVKK Art. 6/1) is also required. In this way, your personal data is processed in a manner that is both appropriate to its purpose and compliant with the law.
Your personal data will be retained for the reasonable period specified in the relevant legislation or until the purpose of processing ceases to exist, and in any case for the legal statute of limitations periods.
Transfer of Contestant Candidates' Personal Data to Third Parties:
The transfer of your personal data to third parties is carried out in accordance with the procedures and principles determined in Articles 8 and 9 of the Personal Data Protection Law No. 6698 (KVKK). These transfers are made to various recipient groups for different purposes.

Your personal data may be shared with these groups for the purpose of planning GAIN Media's activities, managing organizations and events, ensuring information security, and conducting data storage and archiving processes.

Your personal data may be shared with relevant suppliers for the purpose of ensuring physical location security.
Authorized Public Institutions and Organizations:

Suppliers Located Abroad:
Due to the fact that the servers of some applications and systems used for the conduct of communication activities and organization management are located abroad, your data may also be transferred to suppliers abroad.
In these transfer processes, all necessary measures are taken for the security and protection of both your personal data and special category personal data.
Rights of Data Subjects
In accordance with Article 11 of KVKK, you can make requests to our Company regarding the following matters about your personal data:
- Learning whether your personal data is processed,
- Requesting information if your personal data has been processed,
- Learning the purpose of processing your personal data and whether they are used in accordance with this purpose,
- Learning the third parties to whom your personal data is transferred domestically or abroad,
- Requesting correction of your personal data if it is processed incompletely or incorrectly, and requesting notification of the operation performed in this scope to third parties to whom personal data is transferred,
- Requesting deletion, destruction or anonymization of your personal data if the reasons requiring their processing cease to exist, and requesting notification of the operation performed in this scope to third parties to whom personal data is transferred,
- Objecting to the emergence of a result against the data subject as a result of analysis of the processed data exclusively through automatic systems,
- Requesting compensation for damages suffered due to unlawful processing of personal data.
For your requests arising from KVKK, you can apply to the Company through the communication channels on the Company's Internet site or through kvkk@gain.com.tr. Gain Media will finalize your application requests in accordance with Article 13 of KVKK, according to the nature of the request and free of charge within 30 (thirty) days at the latest. If the operation requires an additional cost, it is possible to request the fees in the tariff determined by the Board from the relevant person. If the request is rejected, the reason/reasons for rejection are notified to you in writing or electronically with their justifications.
This Information Text may be revised by our Company when deemed necessary. In cases where revision is in question, you will be informed about this matter.
