Code Terms of Use

CODE TERMS OF USE

These Code Terms of Use (“Terms”) are prepared as an annex to the Subscription Agreement (“Agreement”), which establishes the membership and subscription relationship between Gain Medya A.Ş. (“GAİN”) and the Members and Subscribers, and are an integral part of the Agreement. This Form will be approved by the user when the user clicks on the “I Read and Accept the Code Terms of Use” button in the electronic environment and the acceptance declaration is recorded in the GAİN records.

1. Parties and Scope

These Terms are valid between Gain Medya A.Ş. (“Gain”), the creator of the codes that allow access to the Gain digital platform (“Code”) and the owner of all kinds of intellectual and industrial property rights and other rights of these Codes, and the persons who use this Code (“User/Users”), and determine the terms and conditions regarding the use of the Codes.

2. Activation of Codes

2.1. If the code owner has an account at ww.gain.tv, they can benefit from the Codes they have by logging in to their existing account, or if they do not have an account, by registering at ww.gain.tv.

2.2. Code activation transactions are only made through the www.gain.tv web address, and code activation is not made through the Gain

Mobile application.

3. Establishment and Enforcement

3.1. After the user completes their membership transactions by entering the https://www.gain.tv/uye-ol extension web address,

the User accepts these Terms by entering the Code sent to them in the "Use Code" field on the Subscription Confirmation screen and pressing the "Apply" button.

3.2. By using the Code, the User accepts and declares that they have electronically confirmed these Terms within the meaning of Article 9/A-2 of the Consumer Protection Law, that they have knowledge of the basic characteristics of the digital content services subject to membership in accordance with the relevant legislation and all other issues, and that these Terms of Use are binding.

4. Code Terms of Use

4.1. Codes must be used within the period they are valid. If the Codes are not used within the relevant validity period, the Codes will become unusable and will not be subject to return, refund or exchange.

GAIN has no responsibility regarding Codes that are not used within the relevant period.

4.2. Codes are only valid on the https://www.gain.tv/ website. Users accept that they are aware that the Code cannot be used by any other seller/service provider in any way and cannot be positioned as a payment instrument for the purchase of third-party goods and services.

4.3. Purchased Codes do not have a cash redemption value and cannot be exchanged for cash or requested to be exchanged.

4.4. The Code can only be used by the persons who matched the contact address used to match the Code. In this way, any transaction made with the defined contact address and Code information will be deemed to have been made by the User.

4.5. Codes can only be used once. Used Codes lose their validity and cannot be used again.

4.6. Codes only provide access to Gain digital content for a certain access period. After the Code expires, the Users' subscription will be terminated. Users whose Code expires have the right to re-subscribe by completing the Subscription purchase process upon request.

4.7. GAİN is not responsible in any way for the loss of the Code and its use by third parties, and in such a case, GAİN is not obliged to provide or transmit a new Code to the Users.

4.8. The rules in the Subscription Agreement apply to matters not regulated in these Terms.

5. CHANGE

Gain may unilaterally change the terms and conditions of this Agreement at any time at its sole discretion.

6. OTHER PROVISIONS6.1. GAİN may transfer and assign its rights and obligations regarding the relationship established by accepting these Terms to another person at any time.

6.2. Users accept that GAİN may temporarily suspend digital content services due to a technical problem and/or technological developments that are not caused by GAİN's fault in the use of Codes and access to digital content. In this case, Users accept and declare that they will not claim any rights or receivables from GAİN under any name, such as damages, compensation, etc.

6.3. In case of any need for information regarding the use of the Codes or other issues regarding the Codes, the necessary information can be obtained from destek@gain.com.tr or from the call center at 444 0 830.
