*A user who wants to access all kinds of digital content (“Digital Content”) such as movies, documentaries, music, live TV broadcasts, series, news, etc. over the internet via www.GAİN.tv digital platform and/or GAİN mobile applications (“GAİN Digital Platforms”) via internet-connected computers, tablets, smart phones, smart televisions and all similar devices/methods that allow access to the GAİN digital platform and/or mobile applications.

It is established electronically between GAİN and the Subscriber. In this Agreement, GAİN and the Subscriber will be referred to individually as a “Party” and collectively as the “Parties”.

PREVIOUS INFORMATION

Subject: The purpose of the preliminary information; It is the purpose of informing consumers about the subscription agreement to be established with GAİN so that consumers (subscribers) can benefit from the content offered to consumers via Gain Digital Platforms, within the scope of all relevant legislation, primarily the Law on the Protection of Consumers No. 6502 and the Regulation on Subscription Agreements, which entered into force three months after the date of publication by the Ministry of Customs and Trade in the Official Gazette dated 24.01.2015 and is in force on the date of this agreement.

Digital Content Provider Company Information: In this context, the information regarding GAİN, which is on the service provider side in this Agreement concluded between the Parties, is included in Article 1 of this Agreement. Subscribers can request information regarding all issues related to the services offered to them by GAİN, payment terms, GAİN membership status, membership terms and conditions through these channels, and they can also make their complaints and termination notifications through these channels.

Digital Content Service Features, Usage and Fee: The basic features, contents and subjects of Digital Content are specified on the GAİN Digital Platform. The nature of the service provided to the Subscriber is briefly; in return for the fee to be paid by the Subscriber under this Agreement, the provision of all kinds of digital content such as local and foreign TV series and movies, documentaries, news, music, sports, entertainment programs as well as live broadcasts from Gain Digital Platforms via internet-connected computers, tablets, smartphones, smart televisions and all similar devices/methods that allow access to the GAİN digital platform and/or mobile applications via www.GAİN.tv digital platform and/or GAİN mobile applications.

The fee to be paid by the Subscriber in return for the goods/services subject to this Agreement is regulated in Article 6 of the Agreement titled “Subscription Agreement Fee”. As long as the Subscriber pays the fee for the period they purchased, they will be able to watch the Digital Content on the GAİN Digital Platforms over the internet. GAİN reserves the right to change the subscription fee and the Digital Contents on GAİN Digital Platforms.

This Agreement is for an indefinite period and unless the Agreement is terminated, the monthly subscription fee determined by Gain will be collected from the payment instrument determined by the Subscriber on the relevant day of each month corresponding to the date of the Agreement, starting from the date of the Agreement. The Subscriber reserves the right to terminate the Agreement within the scope of the relevant legal legislation.

If the Subscriber benefits from a campaign after the signature of the Agreement, the campaign terms will be valid during the campaign period. In case of such a campaign, the Subscriber will be required to explicitly or implicitly approve an additional protocol to be prepared by GAİN in addition to this Agreement regarding the relevant campaign in order to benefit from the campaign. At the end of the campaign, the subscription will continue from where it left off and within the terms specified in this Agreement.

Delivery and Place of Performance of Digital Content Service: After the Subscriber reads and accepts the entirety of this article and the Agreement, which is a Preliminary Information Form for accessing the Digital Content Service, the Digital Content Service begins to be provided electronically from the moment the subscription fee is collected.

If the subscription fee cannot be collected by GAİN for any reason during the establishment of the subscription agreement and/or during the ongoing period, GAİN has no obligation to provide and provide the Digital Content service for this period.

The Digital Content offered to subscribers by GAİN, which is the subject of this Agreement, can be loaded/used on smart devices through the devices and applications specified in the App Store, Google Play, AppGallery, SmartTV, androidtv, Content Store applications and the www.gain.tv homepage menu and in the https://www.gain.tv/sikca-sorulan-sorular section in this menu. GAİN has no responsibility regarding this Agreement due to the inability to access the service offered by GAİN due to technical problems experienced in these intermediary channels, and the Agreement continues to have effect and consequences for the parties.
